A BILL to amend article one, chapter twenty-five of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
twelve; to amend article six, chapter twenty-nine of said code
by adding thereto two new sections, designated sections ten-b
and ten-c; and to amend article five-e, chapter forty-nine of
said code by adding thereto a new section, designated section
five-b, all relating to the salaries and civil service
classifications of certain employees in the divisions of
corrections and juvenile services.
Be it enacted by the Legislature of West Virginia:

That article one, chapter twenty-five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twelve;
that article six, chapter twenty-nine of said code be amended by
adding thereto two new sections, designated sections ten-b and
ten-c; and that article five-e, chapter forty-nine of said code be
amended by adding thereto a new section, designated section five-b,
all to read as follows:
CHAPTER 25. DIVISION OF CORRECTIONS.
ARTICLE 1. ORGANIZATION AND INSTITUTIONS.
§25-1-12. Salary increase for certain employees.

Notwithstanding any provision of this code to the contrary,
the commissioner shall increase the annual salary of every division
employee, employed by the division on the first day of July, two
thousand one, whose duty station is in the confines of a
correctional facility that houses inmates. The increase shall be
equal to an amount so that when combined with any increase an
employee is provided as a result of the increase in the pay plan,
as required by section ten-b, article six, chapter twenty-nine of
this code, the employee's annual salary is increased three thousand
dollars.
CHAPTER 29. MISCELLANEOUS BOARDS AND OFFICERS.
ARTICLE 6. CIVIL SERVICE SYSTEM.
§29-6-10b. Modification in pay plan for certain correctional employees.

Notwithstanding any provision of this code to the contrary,
the board shall increase, by three thousand dollars, every step in
the pay plan adopted under the provisions of section ten of this
article, as the plan applies to employees of the division of
corrections whose duty stations are in the confines of a
correctional facility that houses inmates.
§29-6-10c. Reclassification of and increase in pay plan for
certain juvenile detention officers.

Notwithstanding any provision of this code to the contrary,
the board shall:

(1) Change the classifications designated as juvenile
detention officer I to correctional officer I and juvenile
detention officer II to correctional officer II; and

(2) Increase by three thousand dollars, every step in the pay
plan adopted under the provisions of section ten of this article,
as the plan applies to employees of the division of juvenile
services working in these classifications whose duty stations are
in the confines of a juvenile detention center or a juvenile
correctional facility.
CHAPTER 49. CHILD WELFARE.
ARTICLE 5E. DIVISION OF JUVENILE SERVICES.
§49-5E-5b. Salary increase for certain employees.

Notwithstanding any provision of this code to the contrary,
the director shall increase the annual salary of every juvenile
detention officer, reclassified as a correctional officer under the
provisions of section ten-c, article six, chapter twenty-nine of
this code, employed by the division on the first day of July, two
thousand one, whose duty station is in the confines of a juvenile
detention facility or juvenile correctional facility. The increase
shall be equal to an amount so that when combined with any increase
an employee is provided as a result of the reclassification and
increase in the pay plan, as required by section ten-c, article
six, chapter twenty-nine of this code, the employee's annual salary
is increased three thousand dollars.

NOTE: The purpose of this bill is to increase the salaries of
employees of the Division of Corrections and the Division of
Juvenile Services that work in correctional facilities. The bill
also requires that certain positions in the Division of Juveniles
be reclassified as Correctional Officers.
